Abstract

Breach of contract does not produce one fixed legal outcome. Courts classify breach as minor, material, or anticipatory, each triggering different consequences. This research examines how classification determines available contractual remedies across commercial, consumer, and employment contracts. Existing scholarship treats remedies as isolated tools rather than a connected framework, leaving courts without clear guidance. This study aims to connect breach classification directly to remedy selection through qualitative doctrinal and document analysis. Legal texts, treaties, and scholarly literature were examined across multiple jurisdictions, including common law, civil law, and international sales conventions. Findings show that classification, not harm alone, determines whether compensation, termination, or suspension applies. Anticipatory breach remains inconsistent across courts, while penalty clauses and mitigation duties complicate outcomes. This research recommends clearer statutory standards and extending classification principles to digital and preliminary agreements. These findings offer courts, lawyers, and policymakers a unified framework for resolving breach disputes more fairly.
